Do Employers Have To Do Background Checks On Prospective Employees?
Employers generally do not have to do background checks on perspective employees. It’s recommended that they do, but there are a certain category of employees where an employer is required to do a background check. And those are employees that are going to work with what we call the vulnerable population. So if you have an employee that’s going to work with the elderly, or is going to work with children or others with certain disabilities, then the employer is actually required under law to do background checks on those individuals.
