Can an employer be liable for responding to background inquiries regarding a current or former employee?

Florida law generally protects employers that are responding to questions about former employees. So if a new company calls a former employer and asks questions about a former employee, the former employer will generally not be liable so long as the information provided is true and accurate and doesn’t violate that employee’s civil rights. This law actually also applies to current employees that are looking for a position as well.
