Who decides a case in commercial litigation?

If a lawsuit is filed, the case will ultimately be decided by either a judge or jury, depending on whether the causes of action allow for a jury to decide the matter and whether the parties have demanded the right to a jury trial. In an alternative dispute resolution proceeding such as an arbitration, an arbitrator will decide the case. The arbitrator will typically be either a former judge or an attorney with specialized knowledge.
