Do bicyclists automatically have the right of way?
When riding a bicycle on the roadway, you have the same rights as a motor vehicle, so you have to abide by the same right-of-way rules as a motor vehicle. The one exception that does apply is when a bicycle is in a crosswalk. Then, you would have the right-of-way, just like a pedestrian would in a crosswalk as to a motor vehicle. However, you do not have the right-of-way if you’re in a crosswalk as to a pedestrian. The pedestrian would have the right of way over the bicycle.
