It depends. Some cases can be heard in Federal Court if they involve citizens from different states and there’s at least $75,000 in controversy in the case. Now for most commercial cases, you’ll be finding over more than $75,000, so that’s not the problem. The problem will be the citizenship of the parties to the case. Alternatively, if you’re commercial litigation case involves a question of federal law, then you have a right to take the case to Federal Court. The real issue you should be asking yourself is not whether I can litigate in Federal Court, but whether Federal or State Court would be the better form for me in this instance.
